By accessing the Website or placing an order, you confirm that:

you are at least 18 years of age;
all information provided by you is true, complete and accurate;
you are legally permitted to purchase the products ordered; and
you are not purchasing products for or on behalf of an individual below 18 years of age.

VAPE HAUS may request proof of age before accepting, processing or dispatching an order.

Acceptable identification may include:

Malaysian Identity Card;
passport;
driving licence; or
another government-issued identification document.

If satisfactory age verification cannot be completed, VAPE HAUS may:

Any payment received for a cancelled order will be handled in accordance with our Refund Policy and applicable law.

applicable Malaysian laws or regulations;

product-safety concerns;
manufacturer or supplier updates; or

VAPE HAUS may refuse, suspend or cancel an order where reasonably necessary for legal, regulatory, fraud-prevention or safety reasons.

legalises or authorises a sale, purchase, possession, distribution or use that is prohibited by law;
removes any obligation imposed on VAPE HAUS under applicable law; or
removes any legal responsibility imposed on a customer.

Customers must not unlawfully modify, resell, distribute or supply products purchased from VAPE HAUS.

5. Product Information

VAPE HAUS makes reasonable efforts to ensure that product descriptions, specifications, compatibility information, prices and images displayed on the Website are accurate.

However:

product images are provided for general illustration;
colours may vary depending on screen or device settings;
measurements may be approximate;
manufacturers may update packaging, labels, accessories, authentication methods or appearance; and
minor differences may occur between Website images and the product supplied.

Minor manufacturer changes that do not materially alter the product’s identity, function or essential characteristics will not, by themselves, constitute a defect or grounds for return.

Nothing in this section limits any remedy available where a product materially differs from its description or where a remedy is required under applicable law.

Customers are responsible for reviewing product descriptions and compatibility information before placing an order.

6. Product Use and Safety

Products must be used, charged, stored, maintained and disposed of in accordance with:

Customers must stop using a product immediately if it appears:

damaged;
swollen;
overheated;
leaking;
physically compromised; or
otherwise unsafe.

Rechargeable batteries and devices must only be used with compatible equipment and accessories.

Subject to rights and liabilities that cannot legally be excluded, VAPE HAUS is not responsible for loss, damage or injury caused by:

product misuse;
improper storage;
improper charging;
use of incompatible products or accessories;
failure to follow manufacturer instructions;
unauthorised modification or repair; or
continued use after a fault or safety concern becomes apparent.

7. Product Availability

All products are subject to availability.

Although VAPE HAUS makes reasonable efforts to maintain accurate inventory information, stock discrepancies may occur because of:

simultaneous orders;
system or inventory-sync delays;
inventory adjustments;
damaged stock;
supplier shortages; or
other operational circumstances.

If a product becomes unavailable after an order has been submitted, VAPE HAUS may:

offer an alternative product, subject to the customer’s agreement;
provide store credit, subject to the customer’s agreement; or
refund the amount paid for the unavailable product.

VAPE HAUS may limit product quantities or refuse unusually large orders where reasonably necessary for stock management, fraud prevention, regulatory requirements or other legitimate business reasons.

8. Orders and Order Acceptance

Submitting an order constitutes an offer to purchase the selected products.

An automatically generated order-confirmation email acknowledges that the order has been received but does not necessarily constitute final acceptance.

An order is accepted when VAPE HAUS:

confirms dispatch; or
otherwise expressly confirms that the order has been accepted.

Before acceptance, VAPE HAUS may verify:

payment;
age or customer eligibility;
order information;
stock availability;
delivery information; and
fraud or security indicators.

VAPE HAUS may refuse or cancel an order because of:

unavailable stock;
incorrect or obviously erroneous pricing;
failed or unverified payment;
suspected fraud or unauthorised payment;
inaccurate customer information;
failed age verification;
legal or regulatory requirements;

other reasonable legal, safety or operational grounds.

If VAPE HAUS cancels a paid order, the amount paid for the cancelled products will be handled in accordance with our Refund Policy and applicable law.

VAPE HAUS will not substitute a paid product with a materially different product without the customer’s agreement.

9. Order Accuracy and Amendments

Customers are responsible for reviewing all order details before completing payment, including:

product;
model;
flavour;
colour;
resistance;
nicotine strength, where applicable;
quantity;
billing information;
delivery address; and
contact details.

Once an order has entered processing or fulfilment, VAPE HAUS may be unable to accommodate:

cancellation requests;
product changes;
quantity changes;
address amendments; or
other order modifications.

Incorrectly selected products and change-of-mind purchases are handled in accordance with our Refund Policy.

10. Pricing and Errors

All prices displayed on the Website are in Malaysian Ringgit unless otherwise stated.

Prices may change without prior notice due to:

supplier-price changes;
market conditions;
promotions;
inventory changes;
tax or regulatory requirements; or
other business considerations.

The applicable price will normally be the price displayed at checkout when the order is submitted.

VAPE HAUS may correct:

pricing errors;

12. Promotions, Vouchers and Rewards

promotional discounts;
voucher or coupon codes;
free-shipping promotions;
loyalty rewards;
free gifts;
clearance offers; or
campaign-specific benefits.

Unless otherwise stated:

only one promotional code may be used per order;
promotions cannot be combined;
promotional codes cannot be applied retrospectively;
promotions and rewards have no cash value;
promotional benefits are subject to availability;
minimum-spend or product-exclusion conditions may apply; and
free-shipping offers may be modified or withdrawn without prior notice.

VAPE HAUS may reject, suspend or cancel a promotional benefit where:

misuse or abuse is suspected;
multiple accounts are used improperly;
a code was obtained or distributed without authorisation;
a system or pricing error has occurred; or
fraudulent activity is suspected.

Specific promotional terms will prevail over these general terms where a conflict arises.

13. Shipping and Delivery

VAPE HAUS currently provides domestic delivery within Malaysia only.

Order processing, delivery partners, estimated delivery times, tracking, proof of delivery, delivery disputes and risk of loss are governed by our Shipping Policy.

Any delivery time displayed on the Website or communicated by customer support is an estimate unless expressly stated otherwise.

Customers are responsible for providing accurate and complete delivery information.

14. Refunds, Returns, DOA Claims and Warranties

All refunds, returns, Dead on Arrival claims, exchanges, incorrect-item claims, delivery-damage claims and warranty assessments are governed by our Refund Policy.

Due to hygiene, safety and product-integrity considerations, goods sold are generally not refundable, returnable or exchangeable except as expressly stated in the Refund Policy or required by applicable law.

Submitting a claim does not automatically guarantee a refund, replacement, exchange, repair or store credit.

Nothing in these Terms excludes any remedy that cannot legally be excluded.

20. Disclaimer of Warranties

every product will meet a customer’s subjective preferences; or

Nothing in this section excludes an express warranty or statutory protection that cannot legally be excluded.

21. Limitation of Liability

To the fullest extent permitted by applicable Malaysian law, VAPE HAUS will not be liable for indirect, incidental, special or consequential loss arising from:

improper charging or storage;

failure to follow manufacturer instructions;
unauthorised account activity caused by the customer’s failure to protect account credentials;
independent third-party services; or
circumstances beyond our reasonable control.

Where liability may lawfully be limited, VAPE HAUS’s aggregate liability relating to a particular product will not exceed the amount paid for that product.

Nothing in these Terms excludes or limits:

liability that cannot lawfully be excluded or limited;
mandatory consumer rights; or
any remedy required under applicable Malaysian law.

22. Indemnity

To the extent permitted by law, you agree to indemnify VAPE HAUS against reasonable third-party claims, losses or costs arising directly from:

your unlawful use of the Website;
your material breach of these Terms;
fraud or intentional misconduct;
infringement of another person’s rights; or
unlawful resale, distribution or modification of products.

This section does not require you to indemnify VAPE HAUS for loss caused by VAPE HAUS’s own breach, negligence or unlawful conduct.

23. Force Majeure

VAPE HAUS will not be liable for delay or failure to perform an obligation caused by events beyond our reasonable control, including:

natural disasters;
fire or flood;
epidemics or pandemics;
government action;
legal or regulatory restrictions;
labour disputes;
supplier interruptions;
courier disruptions;
internet or telecommunications failures;
system outages;
cyber incidents; or
other events that could not reasonably be prevented.

VAPE HAUS will make reasonable efforts to minimise disruption and resume affected operations where practicable.

24. Suspension and Termination

VAPE HAUS may suspend or terminate access to the Website or a customer account where reasonably necessary because of:

breach of these Terms;
suspected fraud;
unauthorised payment activity;
unlawful use;
abuse of promotions;
security concerns;
underage access; or
legal or regulatory requirements.

Termination does not affect:

orders already completed;
amounts already due;
accrued rights or liabilities; or
provisions intended to continue after termination.

25. Severability

If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision will be modified or severed only to the extent necessary.

The remaining provisions will continue in full force and effect.

26. No Waiver

A failure or delay by VAPE HAUS in enforcing a provision of these Terms does not waive our right to enforce it later.
